1. Using PushForm
These Terms govern your use of the PushForm website and hosted services provided by JobCraft, Inc. ("JobCraft," "we" or "us"), a Delaware corporation based in Oregon, United States. By using PushForm, you agree to these Terms. If you do not agree, do not use the service. Our Privacy Policy explains how we handle information.
These Terms require disputes to be resolved by binding individual arbitration and waive class actions and jury trials, as described in section 15.
You must be at least 13 and legally able to agree to these Terms. If you are below the age of legal majority, a parent or legal guardian must authorize your use. If you use PushForm for an organization, you represent that you have authority to agree on its behalf.
2. Your account
Provide accurate account information, protect your sign-in email and credentials, and notify support@pushform.io about unauthorized access. Do not share your credentials or let anyone else use your account; an Individual license is for one person. You are responsible for activity under your account. Sign-in may be required even for local file operations.
3. Permission to use the product
Subject to these Terms and your applicable plan, JobCraft grants you a limited, non-exclusive, non-transferable and revocable permission to access its hosted service. JobCraft and its licensors retain rights in the service, branding and software, except for rights granted by a separate software or open-source license.
PushForm is available under the GNU General Public License, version 3 (GPLv3). See our open-source page for the public source repository. The software license supplied with a particular copy controls your rights to use, copy, modify and distribute that copy. Nothing in these Terms, including plan eligibility, account requirements, acceptable-use restrictions, termination, dispute resolution or future updates, adds conditions to or limits rights granted by that software license. GPLv3 permits commercial use. Hosted accounts, cloud storage and other services remain subject to these Terms. A software license does not grant rights to the PushForm trademarks or access to our hosted infrastructure.
4. Your files and designs
You retain ownership of your files, designs and other content. You grant JobCraft and its service providers the limited rights needed to host, copy, transmit, back up and process that content to provide the features you use, including displaying published files to others. This does not transfer ownership of your designs to us or give us a general right to publish private work.
You must have the rights and permissions needed to upload, use and publish your content, including client work and third-party components. Do not upload confidential material you are not authorized to provide.
Private files remain private forever unless you explicitly publish them. A subscription change, cancellation or expiration never makes a private file public. Private-file handling is described in the Privacy Policy.
5. Publishing
You may publish a file only if you created and own it, or you have the right to redistribute it publicly, including every component it contains, under the license you choose when you publish it. By publishing, you confirm that you have these rights and that the license you choose does not conflict with any terms that apply to the file or its components. You are responsible for that choice and for keeping any notices those terms require.
Using someone else's published file is subject to the license or terms they attach to it, and you are responsible for following those terms.
Publishing authorizes the public display and access required by that publishing action. Copies already downloaded by others remain outside our control. Public publishing may not yet be available in your build.
6. Hosted editions and availability
The following plan and file-storage rules apply to the hosted service only. They are not restrictions on GPL-covered software copies or their commercial use.
Community Edition: available without a subscription. Files become public only when you explicitly publish them.
Individual: a subscription for one individual. See the pricing page for current prices. Applicable taxes and final purchase terms are disclosed at checkout.
Pro: coming soon. Collaboration, file sharing, user management and single sign-on are planned.
Features and plan availability can vary by build and rollout stage. Planned features are not a promise of a delivery date or functionality available today. Public publishing may not yet be available. The pricing page describes the announced offering; any actual purchase must disclose the applicable price, billing and cancellation terms before you agree.
7. Payments, renewal and cancellation
Individual subscriptions renew automatically at the monthly or annual interval selected at checkout until you cancel future renewal. Cancel through Plan and billing → Manage account in your PushForm account; cancellation takes effect at the end of the current billing period.
If you purchase a paid plan, you authorize only the charges and any recurring billing you expressly agree to at checkout. The checkout must disclose the amount, billing interval, any applicable taxes, renewal terms and cancellation method. These Terms alone do not authorize a charge or enroll you in automatic renewal.
You may cancel future renewal through the method provided at purchase or by contacting support@pushform.io. Refund requests and billing disputes can be sent to that address. Any stated purchase-specific refund policy and mandatory legal refund rights apply; these Terms do not waive those rights. A price change will not alter an already-paid billing period and will be communicated before it applies to a later purchase or renewal.
8. Acceptable use
Do not use PushForm to violate law or others' rights, distribute malware, access accounts or files without permission, evade access controls, disrupt the service, harass others, or publish content you have no right to share. Do not probe or exploit the service in ways that harm other users or expose their data. Report suspected security issues to our support address.
These restrictions apply to our hosted service, not to activities authorized by the software license supplied with your copy. Except as applicable law allows despite a restriction, do not:
- reverse engineer, decompile or attempt to extract the source code of PushForm's hosted services;
- scrape, crawl or bulk-download the service or other users' published files by automated means, except through interfaces we document for that purpose;
- use the hosted service, or data collected from it, to build or train a competing product or service;
- resell, rent or provide PushForm's hosted services to others without our written permission.
Do not upload or store data that is subject to special legal controls, including technical data controlled under the U.S. International Traffic in Arms Regulations (ITAR) or Export Administration Regulations (EAR), classified information, or protected health information.
You must comply with U.S. and other applicable export control and sanctions laws. You represent that you are not located in a country or region subject to comprehensive U.S. sanctions and are not on a U.S. government list of prohibited or restricted parties.
9. Copyright complaints
We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act. Send notices to our copyright agent at support@pushform.io with the subject "Copyright notice." A notice must include:
- your physical or electronic signature, as the copyright owner or a person authorized to act for them;
- identification of the copyrighted work you claim is infringed;
- identification of the material you claim is infringing, with a link or enough detail for us to locate it;
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.
We may remove or disable access to material that is the subject of a notice. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address as the law allows. We may terminate the accounts of repeat infringers in appropriate circumstances.
10. Feedback
If you send us suggestions, ideas or other feedback about PushForm, you grant JobCraft a perpetual, irrevocable, worldwide, royalty-free right to use it for any purpose without obligation to you. This does not give us rights in your files or designs.
11. Check your work before building
PushForm helps you design and visualize projects. You are responsible for verifying dimensions, materials, clearances, structural suitability and fabrication instructions before manufacturing, cutting or construction. Models, imports, calculations and AI output can contain errors. PushForm does not replace professional engineering advice or required approvals.
12. Service changes, suspension and termination
We may update the service, change features, or suspend or terminate your access to address misuse, security risks, legal requirements or breaches of these Terms. Where reasonably practicable and legally permitted, we will give notice and an opportunity to resolve the issue. You can stop using the service at any time.
You can delete your account from your account details in PushForm. We delete it, together with your stored files and account information, 48 hours after you confirm, and you can cancel the deletion until then. Deletion cannot be undone. Before deleting your account, you can export your saved files from the same place; we email you a download link that works for 24 hours. Requesting account deletion does not stop renewal during the 48-hour window; use Manage account in Stripe to cancel renewal sooner. Any remaining recurring subscription is cancelled before permanent account erasure. You can also contact us to close your account.
Maintain independent copies of important work. Continued storage or access after closure, cancellation, termination or service discontinuation is not guaranteed, and we may delete content from a closed or terminated account. Files that remain stored privately will not become public without your explicit publishing action.
13. Warranties and liability
To the extent permitted by law, PushForm is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee uninterrupted service, error-free results or that every file can be recovered.
To the extent permitted by law, JobCraft is not liable for indirect, incidental, special or consequential losses, including lost profits, lost data or costs arising from fabrication decisions. JobCraft's total liability for all claims relating to these Terms or PushForm is limited to the greater of $100 or the amount you paid JobCraft for PushForm in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded, overrides mandatory consumer rights, or excuses fraud, willful misconduct or gross negligence where applicable law prohibits that exclusion.
14. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless JobCraft and its officers, employees and agents from third-party claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your content (including files you publish and the licenses you choose for them), your use of PushForm, your breach of these Terms, or your violation of law or the rights of others. We may take control of the defense of a claim at our own expense, and you will cooperate with us.
15. Disputes, binding arbitration and class action waiver
Please read this section carefully. It affects how disputes are resolved, and it waives your right to a jury trial and to take part in a class action.
Informal resolution. Before starting arbitration, a party must send the other a written notice describing the dispute and the relief requested: to us at support@pushform.io with the subject "Dispute notice," and to you at your account email. Both parties will try in good faith to resolve the dispute for 30 days after the notice is received.
Binding arbitration. Except as described below, any dispute, claim or controversy arising out of or relating to these Terms or PushForm, including whether a dispute must be arbitrated, will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or its Commercial Arbitration Rules if you use PushForm for an organization. A single arbitrator will decide the dispute and may award the same individual relief a court could. The Federal Arbitration Act governs this section. A hearing takes place in the county where you live or by video conference; for claims under $10,000, either party may choose to have the arbitration decided on written submissions alone. Fees are allocated under the AAA rules, and we will pay the fees those rules assign to businesses.
Exceptions. Either party may bring an individual claim in small claims court instead. Either party may ask a court for injunctive or other equitable relief to stop infringement or misuse of intellectual property or unauthorized access to the service.
Class action and jury trial waiver. You and JobCraft may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and the arbitrator may not combine claims of more than one person. You and JobCraft waive any right to a jury trial. If this waiver is found unenforceable for a claim, that claim will be decided in court after any individual arbitration is complete, not in arbitration.
Opting out. You may opt out of arbitration within 30 days after you first accept these Terms by emailing support@pushform.io with the subject "Arbitration opt-out" and your name and account email. Opting out does not affect the rest of these Terms.
Changes to this section. A change to this section does not apply to a dispute that either party gave notice of before the change was posted.
Governing law and courts. Oregon law governs these Terms, excluding conflict-of-law rules, except that the Federal Arbitration Act governs this section. Any claim that is not arbitrated will be brought in the state or federal courts located in Oregon, and you and JobCraft consent to their jurisdiction.
16. Changes to these Terms
We may change these Terms at any time by posting the revised Terms on this page with a new effective date. Changes take effect immediately when posted. Your continued use of PushForm after a change is posted means you accept the revised Terms. If you do not agree, stop using PushForm. Changes never authorize publication of private files.
17. General
These Terms, the Privacy Policy and any terms you accept at checkout are the entire agreement between you and JobCraft about PushForm. You may not assign or transfer these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control. You agree that we may send notices and other communications electronically, including by email and in the app. Not enforcing a provision is not a waiver of it. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
